Reporting violations of the law

Thus, in compliance with the law, including Directive (EU) 2019/1937 of the European Parliament and of the Council of 23 October 2019 on the protection of persons reporting breaches of EU law (hereinafter referred to as the “EU Directive“) and the Act of 14 June 2024 on the protection of whistleblowers (hereinafter referred to as the “Act“), we have introduced the ability to report violations of the law using the Violations (of the Law) Report Form. The application of specific principles enables the implementation of transparent processes, ensuring the identification and immediate response to received Reports.

As part of our Compliance awareness efforts at PPF HASCO-LEK S.A., we continually work to educate our employees on ethical behavior and compliance with the law and Internal Regulations.

A report of a violation of the law may concern (in accordance with Article 3.1 of the Act):

  1. corruption;
  2. public procurement;
  3. services, products, and financial markets;
  4. counteracting money laundering and terrorism financing;
  5. product safety and compliance;
  6. transport safety;
  7. environmental protection;
  8. radiological protection and nuclear safety;
  9. food and feed safety;
  10. animal health and welfare;
  11. public health;
  12. consumer protection;
  13. privacy and personal data protection;
  14. security of networks and IT systems;
  15. financial interests of the State Treasury of the Republic of Poland, local government units, and the European Union;
  16. the European Union’s internal market, including public-law rules on competition and state aid, and corporate taxation;
  17. constitutional freedom and human and civil rights – occurring in the relationship of an individual with public authorities and not related to the areas indicated in points 1-16

Key rules for  breach reporting:

  1. The reporting person may submit an Internal Report after becoming aware of a violation of law within the scope specified in Article 3.1 of the Act.
  2. An Internal Report should be submitted in good faith, and the reporting person should have a reasonable belief in the accuracy of the information provided.
  3. An Internal Report should contain all relevant information regarding the reported violation of law, including any evidence, such as documents, photographs, recordings, and emails.
  4. An Internal Report may be submitted openly or anonymously. The decision on how to report the information rests with the reporting person in each case.
  5. Feedback is provided only if the Internal Report is submitted openly, with the contact details of the reporting person provided.
  6. The deadlines for confirming receipt of an Internal Report and Feedback to the Whistleblower are specified in Article 25, Section 1, Paragraph 5 and Section 7 of the Act of June 14, 2024, on the Protection of Whistleblowers.
  7. All Follow-up Actions undertaken by the Compliance Organizational Unit at PPF HASCO-LEK S.A. are conducted in compliance with generally applicable law, with due diligence, anonymity, confidentiality, and impartiality.
  8. Before submitting a Report through external channels, it is preferable to use the internal channels available at PPF HASCO-LEK S.A.
  9. The organization of the receipt and verification of Internal Reports, the taking of Follow-up Actions, and the related processing of personal data prevents unauthorized persons from gaining access to the information covered by the Report and ensures the confidentiality of the Whistleblower’s identity, in accordance with the GDPR and the HASCO Group Privacy Policy.
